What would do you if someone have admittingly spit surrounded by your pizza, at the place they work at, contained by a deed message?

This guy, my sister's ex, sent my sister text message admitting to spitting within her food at the papa johns he works at.
I've let the manager know about this and he still let him work there, making people's food. I don't understand, shouldn't someone who has done something resembling this even to others besides my sister be fired?
